Refurbishment and building works terms and conditions

  

1. Installation work a) All refurbishment works will comply with relevant UK Building Regulations in force at the time of the works. b) Where work is to modify or extend existing structures, fittings, or services, quoted costs assume that the existing installation is in adequate condition and compliant with minimum current regulations. Any works required to bring existing conditions up to standard will incur additional costs. c) Unless otherwise stated, all services (e.g., cabling, pipework) will be concealed where practical within the building fabric, voids, or under floors. Where impractical, they will be neatly surface-run and finished appropriately. d) Flooring, wall coverings, or fixtures may require removal to allow works. We will make best efforts to avoid damage and refit to an acceptable standard. Specialist reinstatement is the client’s responsibility unless agreed in writing. e) Where agreed in advance and for an extra charge, walls, floors, or ceilings will be made good to a pre-finish stage (e.g., plaster ready for decoration). Final decoration is excluded unless specified in the scope of work. f) Works within occupied dwellings will be carried out in a clean and tidy manner using dust sheets and appropriate equipment, but dust and disruption are inevitable. g) The agreed contract, quotation, or scope of works defines the expected works. h) The client shall provide reasonable access to water, electricity, and other necessary utilities and toilet facilities free of charge during works. i) Where full property refurbishment is undertaken, the property must be vacant. We do not accept liability for items left within the property. 


2. Exclusions a) Moving furniture or personal belongings to provide access to work areas is not included unless specifically agreed. No liability can be taken for damaged furniture or belongings left within the work area during work b) Builders’ works beyond those specified in the quotation (e.g., major structural alterations, large openings above 2” or 50mm, support structures) are excluded unless detailed in the contract. c) Re-decoration and final finishing are excluded unless stated as included within the scope of work. d) Removal of waste, old fittings, or rubble is excluded unless specified within the scope of work. This can be arranged at additional cost.


3. Plumbing and Water-Related Works a) Where plumbing works are undertaken, all reasonable care will be taken to prevent water damage. However, the client must ensure adequate building insurance is in place to cover accidental leaks or water damage. b) We are not liable for pre-existing faults in plumbing systems that become apparent during works. c) If water shut-off is required, this will be arranged in advance with the client. Any additional costs or delays caused by lack of shut-off access or inability to shut off may be chargeable. 


4. Kitchen and Bathroom Installations a) The client must ensure that any purchased items are available on site before installation dates to avoid delays. b) We are not responsible for defects in client-supplied goods. c) Any alteration to services (e.g., moving water points, electrical outlets) not included in the quotation will be charged as a variation. 


5. Extras and Variations a) Any additional works or variations must be agreed in writing before commencement.b) Variations may affect project timelines and costs.


6. Pricing a) Quoted costs assume continuous and unhindered access to the site.b) Standard working hours are 09:00–18:00 Monday to Friday unless otherwise stated. Extended hours may be required to meet deadlines. c) Additional works not covered in the quotation will be charged at £50.00 per hour plus materials. d) All quotations are valid for 30 days. e) A cooling-off period of 7 days applies from acceptance of the quote, unless works are scheduled to commence sooner. Cancellation after this period may incur reasonable fees to cover any out-of-pocket expenses that the job has already incurred up to the point of cancellation (i.e. structural engineers reports, architect fees, LA fees ETC). 


7. Timelines and Delays a) Project timelines are estimates and may be affected by factors beyond our control, including but not limited to late delivery of materials, adverse weather, or client delays in decision-making. b) We will inform the client of any delays and agree on revised completion dates. c) We are not liable for consequential losses due to delays unless agreed in writing.


8. Deposits and Payments a) A deposit of 10% is required to secure a booking, payable upon acceptance of the quotation. b) Stage payments will be required for works exceeding £3,500 or lasting more than 21 days. c) Unless otherwise agreed in writing, final payment is due upon completion. d) Failure to make payment within agreed terms may result in interest charges at 8% APR. e) Goods ordered specifically for the client will be invoiced and payable in advance. 


9. Compliance a) All work will be carried out in accordance with relevant UK legislation and good industry practice. b) Any agreed deviation from regulations must be confirmed in writing.


10. Risk and Title of Goods a) Risk in all supplied goods passes to the client upon delivery. b) All goods remain the property of Heer services until paid for in full. c) The client is responsible for insuring the property during works.


11. Warranty a) We warrant our workmanship to be free from defects for 12 months from invoice date. b) Warranty excludes materials not supplied by us, accidental damage, and alterations by third parties.


12. Dispute Resolution a) Mediation is the preferred method of resolving disputes. b) Full payment must be made within 5 working days of completion, regardless of disputes, unless otherwise agreed. c) Where subcontractors are used for specialist tasks, we act in good faith but cannot guarantee their work. d) Any agreed remedial works will be undertaken promptly.


13. Photographs and Records a) We reserve the right to photograph or video works for records and portfolio purposes, unless the client requests otherwise in writing before works commence. b) No images will be published without prior client consent.
